1) Driving with excess alcohol 음주운전

It is an offence to drive with an alcohol concentration in your breath, blood or urine which is above the legal limit. The legal limit for alcohol in England and Wales is:
호흡, 혈액 또는 소변에 법적 허용치 이상의 알코올 농도가 있는 상태에서 운전을 하는 것은 범법행위이다. 잉글랜드와 웨일스의 알코올 법적 허용치는 다음과 같다
• 35mg in 100mg of breath 호흡 100mg에 알코올 35mg
• 80ml in 100ml of blood 혈액 100ml에 알코올 80ml
• 107 ml in 100ml of urine 소변 100ml에 알코올 107ml

The maximum sentence for the offence of driving with excess alcohol is a £5,000 fine and/or 6 months’ imprisonment.
허용치 이상의 알코올을 섭취한 채 운전하는 행위에 대한 최고형량은 5,000 파운드 벌금형 그리고/또는 6개월 징역형이다.

The offender will also be disqualified from driving for a minimum of 12 months.
범법자는 최소 12개월 동안 운전이 금지된다.

If the offender has had two or more disqualifications in the last 3 years, he will be disqualified from driving for a minimum of 2 years.
범법자가 최근 3년 동안 2차례 이상 금지처벌을 받은 경우, 최소 2년 동안 운전이 금지된다.

If the offender has been convicted of drink driving in the last 10 years, he will be disqualified from driving for a minimum of 3 years.
범법자가 최근 10년 동안 음주운전으로 인해 유죄판결을 받은 경우, 최소 3년 동안 운전이 금지된다.

The sentencing guidelines are as follows: 형량 기준은 다음과 같다

Failing to provide a specimen of breath
음주측정을 거부한 경우

It is an offence to fail, without reasonable excuse, to co-operate with a police breathalyzer test or to refuse to provide a specimen of blood or urine for analysis. 
호흡측정, 혈액 및 소변 검증을 정당한 이유없이 거부하는 경우는 범법행위이다.

A reasonable excuse for failing to comply might include a medical condition, such as a chest complaint. Waiting for the arrival of or advice from a solicitor is not a reasonable excuse for failing to comply.
거부를 할 수 있는 정당한 이유는 가슴 통증과 같은 건강상 사유가 포함될 수 있다. 변호사의 도착 또는 그가 조언을 해줄 때까지 기다리겠다는 사유는 정당한 이유가 되지 못한다.

The maximum penalty for failing to provide a specimen for analysis where the offender is suspected of drink driving is a £5000 fine and/or 6 months’ imprisonment.
범법자가 음주운전을 했다는 의심을 사서 음주측정을 요구받았을 때 이를 거부한 행위에 대한 최고형량은 5,000 파운드 벌금형 그리고/또는 6개월 징역형이다.

The offender will also be disqualified from driving for a minimum of 12 months.
범법자는 최소 12개월 동안 운전이 금지된다.

If the offender has had two or more disqualifications in the last 3 years, he will be disqualified from driving for a minimum of 2 years.
범법자가 최근 3년 동안 2차례 이상 금지처벌을 받은 경우, 최소 2년 동안 운전이 금지된다.

Causing death by driving with excess alcohol
음주운전으로 인해 사망사고를 일으킨 경우

Where a person who has exceeded the legal alcohol level drives carelessly and causes another person’s death, he is guilty of an offence of Causing Death by Careless Driving when Under the Influence of Drink or Drugs.
음주를 한 상태로 운전하다가 타인의 사망을 일으킨 경우, ‘음주 또는 마약을 한 상태로 부주의한 운전을 하여 사망을 일으킨 범죄’를 저지른 것으로 간주한다.

The maximum sentence for the offence is 14 years’ imprisonment and/or an unlimited fine.
이에 대한 최고형량은 14년 징역형 그리고/또는 무제한의 벌금형이다.

The offender will also be disqualified from driving for a minimum of 2 years and will have to re-pass a driving test before being allowed to drive again.
범법자는 최소 2년 동안 운전이 금지되며, 운전시험을 재합격해야 운전을 할 수 있게 된다.

2) Dangerous driving 위험운전

A person is guilty of dangerous driving if he drives dangerously on a road or other public place.
도로나 다른 공공장소에서 위험한 운전을 하는 경우 범법행위이다.
‘Dangerous driving’ is where the standard of a person’s driving falls far below that expected of a competent and careful driver.
‘위험운전’이란 평상시 능력있고 조심성있는 운전자의 운전 수준보다 많이 떨어진 운전 수준을 보일 때를 지칭한다.

Examples of dangerous driving include: 위험 운전의 예는 다음과 같다:
- Racing or competitive driving; 경주할 경우
- Speed which is highly inappropriate for the road or traffic conditions; 교통 및 도로 상황에 맞지 않는 속도를 낼 경우
- Aggressive driving such as sudden lane changes, cutting into a line of vehicles or driving too close to the vehicle in front; 갑작스런 차선변경, 차 사이로 무리하게 끼어들기 또는 앞차와의 간격을 충분히 두지 않는 공격적 운전을 할 경우
- Deliberate disregard of traffic lights and other road signs; 신호등 및 기타 도로 경고판을 고의적으로 무시하는 경우
- Disregard of warnings from fellow passengers;
- 동승객의 경고를 무시하는 경우
- Dangerous overtaking; 위험하게 추월하는 경우
- Driving with a load that presents a danger to other road users; 다른 운전자들에게 위험을 미칠 만한 짐을 실고 운전하는 경우
- Driving with an impairment such as poor eyesight; 시각 장애 등의 건강 문제를 가진 채로 운전하는 경우
- Driving when too tired to stay awake; 피로한 상태에서 운전하는 경우
- Driving a vehicle with a dangerous defect. 고장난 차를 운전하는 경우

The maximum sentence for dangerous driving is 2 years’ imprisonment and/or an unlimited fine. 이에 대한 최고형량은 2년 징역형 그리고/또는 무제한의 벌금형이다.

Death by dangerous driving

Where death results from the person’s dangerous driving, he is guilty of the offence of Causing Death by Dangerous Driving.
위험운전을 하다가 타인의 사망을 일으킨 경우, ‘위험 운전을 하여 사망을 일으킨 범죄’를 저지른 것으로 간주한다.

The maximum sentence is 14 years’ imprisonment and/or an unlimited fine.
이에 대한 최고형량은 14년 징역형 그리고/또는 무제한의 벌금형이다.

3) Careless driving 부주의한 운전

If a person drives a vehicle without due care and attention or without reasonable consideration for other persons using the road or public place, he is guilty of Careless Driving or Driving without Due Care and Attention.
다른 운전자 또는 보행자들의 안전을 고려하지 않고 부주의하게 운전하는 경우, ‘부주의 한 운전 또는 배려를 하지 않은 운전을 한 범죄’를 저지른 것으로 간주한다.

‘Careless driving’ is where a person’s driving falls below what would be expected f a competent and careful driver.
‘부주의운전’이란 평상시 능력있고 조심성있는 운전자의 운전 수준보다 떨어진 운전 수준을 보일 때를 지칭한다

Examples of ‘careless driving’ include: 부주의한 운전의 예는 다음과 같다:
- Overtaking on the inside; 안쪽선을 이용하여 추월한 경우
- Driving inappropriately close to another vehicle; 다른 차와 너무 가까운 거리에서 운전하는 경우
- Driving through a red light; 신호등이 적색일 때 그냥 지나가는 경우
- Emerging from a side road into the path of another vehicle; 다른 차가 오는데 갓길에서 나오는 경우
- Tuning a car radio; 운전하는 상태에서 카 라디오를 조작하는 경우
- Using a hand held mobile phone or other hand held electronic equipment; 운전하는 상태에서 핸드폰 또는 기타 전자기기를 사용하는 경우
- Selecting and lighting a cigarette where driver is avoidably distracted by that use 운전을방해한다는 것이 역력함에도 불구하고 담배를 꺼내어서 불을 붙이는 경우

Examples of ‘inconsiderate driving’ include: ‘배려를 하지 않은 운전’의 예는 다음과 같다:
- Flashing of lights to force other drivers in front to give way;
- 앞차들이 양보를 하게 만들도록 헤드라이트를 번쩍이는 경우
- Misuse of lane to avoid queuing or gain some other advantage over other drivers;
- 정체를 피하거나 이와 같은 다른 이득을 얻기 위하여 차선을 남용하는 경우
- Unnecessarily remaining in an overtaking lane;
- 추월용 차선 위에 불필요하게 주행하는 경우
- Unnecessarily slow driving or barking without good cause;
- 정당한 이유없이 느리게 운전하는 경우
- Driving with undipped headlights that dazzle oncoming driver;
- 하이빔을 이용하여 오는 차량의 운전자 시야를 방해하는 경우
- Driving through a puddle causing pedestrians to be splashed;
- 웅덩이 위로 주행하여 보행자에게 물을 튀기는 경우
- Driving a bus in such a way as to alarm passengers.
- 승객이 놀랄 정도로 버스를 과격하게 모는 경우

Death by Careless or Inconsiderate Driving 부주의한 운전으로 사망사고를 낸 경우

Where death results from a person’s careless or inconsiderate driving, the maximum sentence is 5 years’ imprisonment and/or an unlimited fine.
부주의 또는 배려없는 운전을 하다가 타인의 사망을 일으킨 경우, 최고형량은 5년 징역형 그리고/또는 무제한의 벌금형이다 .

The offender will be disqualified from driving for a minimum of 12 months.
범법자는 최소 12개월 동안 운전이 금지된다.
