Offences involving false documents:
위조 문서 사용 관련 범죄


The following are criminal offences in England and Wales:
이하는 잉글랜드와 웨일즈에서 범죄행위에 속한다.

1. False accounting 분식회계

•Where a person dishonestly falsifies any account or any accounting record or document, with a view to gaining for himself or causing loss to another.
본인의 이익 또는 타인의 손해를 위해서 부정직하게 분식 회계 행위를 하는 경우

•False accounting also includes destroying, defacing and concealing accounts or accounting records/documents.
회계 장부를 파기하거나 수정하거나 숨기는 행위도 범죄행위이다.

•The max. sentence is 7 years’ imprisonment in the Crown Court.
최고 형량은 Crown Court 에서 선고하는 7년형이다.


2. Forgery 위조
 
•The offence of forgery includes: making, copying, using, or using a copy of a false instrument, with the intention of inducing
somebody to accept the instrument as genuine and by accepting it, to do or not to do some act to his own or another person’s prejudice.
위조 관련 범죄는 위조 문서를 제조, 복사, 사용하거나 복사된 위조문서를 사용하고 타인으로 하여금 그 위조 문서가 정품이라고 믿게 하여 그에 맞게 행동하도록 하는 행위를 포함한다.

•The max. sentence is 10years’ imprisonment in the Crown Court.
최고 형량은 Crown Court 에서 선고하는 10년형이다


3. Identity documents 신분증

• There are a number of offences relating to identity documents (immigration documents, passports, National ID cards, Driving
licences etc.).
신분증 (이민등록증,여권, 주민등록증, 운전면허증 등) 관련 범죄에는 여러 종류가 있다.

• It is an offence to:
다음과 같은 행위는 범죄이다.
-Possess an identity document that is false;
위조된 신분증을 소유하는 행위
-Possess a genuine identity document that had been improperly obtained;
부정한 방법으로 취득한 정식 신분증을 소유하는 행위
-Possess an identity document that relates to someone else.
타인과 관련된 신분증을 소유하는 행위

•If the defendant possesses a false identity document with the intention of using it to establishing false personal information
about himself (his name, age, gender, address, residential status, nationality etc), then the maximum sentence is 10 years’
imprisonment in the Crown Court.
본인에 대한 허위 개인신상정보(이름, 나이, 성별, 주소, 가족사항, 국적 등) 설정을 목적으로 위조된 신분증을 소유하는 경우 최고 형량은 Crown Court 에서 선고하는 10년형이다.

•If the defendant does not possess the false document with the intention of using it to establish false personal information
about himself but does not have a reasonable excuse for being in possession of it, the maximum sentence is 2 years’ imprisonment.
본인에 대한 허위 개인신상정보(이름, 나이, 성별, 주소, 가족사항, 국적 등) 설정을 위한 목적은 아닐지라도 특별하게 합당한 이유 없이 위조된 신분증을 소유하는 경우 최고 형량은 Crown Court 에서 선고하는 2년형이다.

•It is also an offence to possess any apparatus, article or material (software, equipment, machinery, devices, wires, cables etc) which is specially designed or adapted for making false identity documents. The maximum sentence is 2 years’ imprisonment.
위조 문서를 제조하기 위해 특별히 설계된 기구 및 재료(컴퓨터 소프트웨어, 기구, 기계, 전선, 케이블 등)를 소유하는 것도 범죄행위이다. 최고 형량은 2년형이다.

•A defendant who uses a false passport to gain entry into the UK will usually be treated much more severely than a defendant who is in the UK lawfully but uses a false identity document to obtain work.
영국에 입국을 하기 위해 위조된 여권을 사용하는 사람의 경우에는 영국에 합법적으로 입국했으나 직장을 구하기 위해 위조 신분증을 사용하는 사람보다 훨씬 더 가중된 처벌을 받는 것이 보통이다.


4. Counterfeit goods 모조품

•It is an offence for a person to sell any goods which bear a sign identical or likely to be mistaken for a registered trade mark,
without the proprietor’s consent.
등록된 상표의 소유자의 허가없이 그 상표와 똑 같은 또는 같은 것이라고 착각할 정도로 흡사한 상표를 부착한 물품을 파는 것은 범죄행위이다.

•The offence also includes applying a trade mark or similar sign in the labelling, packaging or advertising of goods, without the proprietor’s consent.
등록된 상표의 소유자의 허가없이 레이벨, 포장 및 광고에 그 상표와 똑 같은 또는 같은 것이라고 착각할 정도로 흡사한 상표를 사용하는 것 역시 범죄행위이다.

•It also includes possessing an article which is specifically designed or adapted for making copies of a trade mark sign or
similar sign, without the proprietor’s consent.
등록된 상표의 소유자의 허가없이 레이벨, 포장 및 광고에 그 상표와 똑 같은 또는 같은 것이라고 착각할 정도로 흡사한 상표를 제조하기 위한 기구를 소유하는 것 또한 범죄행위이다.

•The max. sentence for selling, making or possessing counterfeit goods is 10 years’ imprisonment in the Crown Court.
모조품을 팔거나 만들거나 소유하는 행위에 대한 최고 형량은 Crown Court 에서 선고하는 10년형이다.


5. Fraud

•Many of the above offence overlap with each other and many of them can also be charged as fraud.
위에 명시된 범죄행위들은 서로 겹치는 부분이 많으나 대다수는 사기행위로도 처벌될 수 있다.

6. Company officers 회사 이사진

•Where any of the above offences is committed by a company and it is proved to have been committed with the consent or connivance of any director, manager, secretary or other similar officer of the company, that individual will often also be charged with the offence alongside the defendant company.
위의 범죄 행위들이 회사에 의해 저질러졌으며 회사의 이사, 사원, 비서 등 회사의 직원의 동의 및 묵인 하에 저질러진 것으로 증명된다면, 관련 직원은 회사와 더불어 범죄행위자로 처벌된다.
