체포된 피의자의 법적권리(상)

경찰의 조사 권한은 체포, 구금, 심문, 일정 장소 압수, 수색, 개인의 수색 및 샘플 채취 권한을 포함하며, 이는 대부분 Police and Criminal Evidence Act 1984 (경찰 및 형사 증거법 일명, “PACE”)와 관련된 PACE Codes of Practice(PACE 실행지침)에 근거한다.

체포 시

경찰서가 아닌 곳에서 체포된 경우, police constable(경찰관)은 체포된 자를 실행 가능한 즉시 경찰서로 동행하는 것을 원칙으로 한다.

때로, 체포된 자는 경찰서로 바로 동행되는 대신 이후 경찰서에 출석할 것을 전제로 보석으로 풀려나기도 한다. 그러한 경우, 체포된 자는 본인이 체포된 죄명 및 체포사유와 이후 경찰서에 출석해야 한다는 사실, 그리고 보석조건 및 보석조건 변경기회 등에 대한 세부내용 등을 통보받아야 한다.

경찰서 도착 시

대략적으로, 체포된 피의자는 다음의 권리를 가진다(총 10항목):

1.PACE 실행지침을 자문받을 권리.

2.자신의 권리에 대해 서면으로 된 통지서를 받아볼 권리.

3.언제든 무료로 변호사(solicitor)와 비공개 면회를 할 수 있는 권리.

체포된 피의자가 변호사와 면회를 원할 경우, 체포된 피의자는 실행 가능한 즉시 변호사를 만날 수 있어야 하며 Custody officer(구금담당 경찰관)는 지체없이 필요한 조치를 취해 주어야 한다. 2009년의 한 판례(Gearing v DPP)에서는 변호사 면회요청과 경찰관이 변호사를 접촉하는 사이에 걸린 22분이 PACE 지침의 위반이라고 판결했다. 특수한 경우에, 변호사 조력은 전화상으로만 가능하기도 하다.

체포된 피의자는 당직변호사(즉, 당일에 해당경찰서에 당직인 변호사) 혹은 자신의 개인 변호사와의 면회를 요청할 수 있다.

때로, 변호사와의 면회가 지연될 경우가 있는데, 이는 아직 혐의 명목이 확정되지 않은 구금된 피의자가 공소가능한 죄(즉, 선택가능죄 또는 가공소죄)와 관련하여 체포되어 있는 경우에 한한다. 변호사와의 면회 지연은 경찰서 superintendent이상 계급 경찰공무원의 승인을 필요로 하며 아래의 이유로 지연이 필요하다고 믿을 만한 합당한 근거가 있어야 한다:

a) (변호사와의 면회가) 공소가능한 범죄와 관련된 증거를 위협 또는 방해할 소지가 있거나 타인에게 신체적인 부상을 입히거나 방해가 될 소지가 있는 경우,
b) 그러한 범죄를 저지른 것으로 의심되나 아직 체포되지 않은 다른 타인이 경찰의 개입사실을 알아차릴 위험이 있는 경우;
c) 범죄를 통해 획득한 사유물을 회수하는데 방해가 될 소지가 있는 경우;
d) 체포된 피의자가 범죄행위를 통해 이득을 취한 경우, 그 이득을 통한 자산가치를 회수하는 데 방해될 소지가 있는 경우

위의 경우들 외에 변호사 면회를 지연할 합당한 이유가 있다면 지연이 가능하나, 어떠한 경우라도 relevant time (적절한 시간)으로부터 36시간 이상을 지연시킬 수는 없다.

4. 자신의 체포사실에 대해 지인에게 알릴 수 있는 권리

체포되어 경찰서에 구금 중인 자가 요청할 경우, 친구, 친지 혹은 제3자에게 자신의 체포사실과 구금되어 있는 장소를 알릴 권리가 있으며, 이는 실행 가능한 즉시 통보되어야 한다. Custody Officer(구금담당 경찰관)는 체포된 피의자에게 이러한 권리에 대해 알려주어야 한다.

체포된 피의자가 선정한 사람에게 본인의 소재에 대해 알리는 것은 공공비용으로 하고, 체포된 피의자가 요청할 경우, 다른 경찰서로 이송될 때마다 매번 연락을 취할 수 있다. 체포된 피의자가 선정한 사람이 연락 되지 않을 경우, 체포된 피의자는 최대 추가 2명까지 연락할 사람을 새로 지명할 수 있다. 만약 추가 2명 역시 연락이 되지 않을 경우, Custody Officer(구금담당 경찰관)혹은 수사책임자의 재량 하에 구금사실을 전할 수 있도록 추가적인 연락시도를 허가할 수 있다. 체포된 피의자가 자문을 위해 연락할 사람이 없는 경우, Custody Officer(구금담당 경찰관)는 도움을 줄 만한 지역 민간단체를 알고 있어야 한다.

공소가능한 죄명으로 구금 중일 때, (즉, 가공소죄 혹은 선택가능죄) 경찰서 Inspector 이상 계급 경찰공무원의 승인 하에 체포된 피의자의 구금사실의 통지는 ‘적절한 시간’으로부터 추가 36시간까지 지연될 수 있다. 경찰관이 통지를 미룰 수 있는 조건은 변호사 면회를 지연할 수 있는 조건과 일치한다.

5.영어 소통이 어렵거나 농아인의 경우, 통역자(혹은 수화자)의 도움을 받을 권리.

6.외국국적자인 경우, 고등판무관(High Commission), 대사관 혹은 영사관에 연락을 취할 권리.

체포된 피의자가 체포사실에 대해 통보를 해야 할 상호 영사협약으로 맺어진 국가의 시민일 경우, 해당 고등판무관, 대사관 혹은 영사관에 실행 가능한 즉시 통보하여야 한다. 체포된 피의자가 정치적 망명자일 경우는 제외한다.

7.청소년의 경우, 보호자에게 체포 및 구금 사실을 알릴 권리.

8. 청소년, 정신이상자 혹은 정신적으로 취약한 사람일 경우, 적절한 성인(appropriate adult)을 부를 권리.

청소년의 경우 적절한 성인이란 부모나 가디언을 말한다. 정신이상자/취약자의 경우, 적절한 성인이란 친지, 가디언, 체포된 피의자의 보호나 관리를 맡고 있는 자 혹은 (경찰관이나 경찰서 직원이 아닌 자 중에서) 정신이상/취약자를 상대해 본 경험이 있는 자를 말한다. 만약 이중 아무도 없는 경우, 경찰관 혹은 경찰서 직원이 아닌 자 중, 18세 이상의 책임감 있는 성인이 대체한다.

적절한 성인의 역할은:
a.체포된 피의자의 현재 상황과 구금된 이유를 명확히 이해하게끔 해주고,
b.그를 지원, 자문, 보조해 주고,
c.경찰이 적절하고 공정하게 처우하고 있는지 관찰하고, 그렇지 않을 경우 개입할 수 있으며,
d.또한, 경찰과 체포된 피의자 간의 의사소통을 돕고,
e.체포된 피의자가 자신의 권리를 이해하고 그러한 권리를 보호하는 자로서의 ‘적절한 성인’의 역할을 명확히 이해하도록 한다.

9.방문자를 면회할 수 있는 권리(Custody officer<구금담당 경찰관>의 재량 하에).

10.필기도구를 사용할 수 있고, 한 사람에게 합당한 시간 동안 전화통화할 수 있는 권리.

체포된 피의자는 변호사와의 대화내용 외에 자신이 말하는 모든 것을 타인이 읽거나 들을 수 있으며, 그 내용이 증거로 사용될 수 있음을 통보받아야 한다.

Relevant time(적절한 시간)’ 이란 체포된 자가 경찰서에 도착한 시간 또는 체포 후 24시간 중 더 먼저인 시간을 말한다.


THE RIGHTS OF A SUSPECT UNDER INVESTIGATION

Police powers of investigation including arrest, detention, interrogation, entry and search of premises, personal search and the taking of samples are largely governed by the Police and Criminal Evidence Act 1984 (“PACE”) and the associated PACE Codes of Practice.

Upon Arrest

Where a person is arrested at any place other than a police station, the police constable is normally obliged to take him to a designated police station as soon as is practicable thereafter.

In some cases, an arrested person may, instead of being taken to a police station, be released on bail, to attend at a police station on a future date. If so, the arrested person must be given a notice informing him of the offence for which he was arrested, of the grounds of arrest, that he is required to attend a police station and of any bail conditions imposed, and opportunities for seeking a variation of those conditions.

In summary, a detained person has the following rights:

1.To consult the PACE Codes of Practice.

2.To have written notification of his rights.

3.To have free and private access to a solicitor at any time.

Where a person makes a request to consult a solicitor he must, subject to the power of delay, be permitted to consult a solicitor as soon as practicable and the custody officer must act without delay to secure that. In a 2009 case (Gearing v DPP), it was held that a delay of 22 minutes between the request for legal advice and action by the police to contact a solicitor amounted to a breach of PACE. In certain circumstances legal advice can only be provided by telephone.

A detained person can request to speak to either the duty solicitor (i.e. the solicitor that is on duty at the police station that day) or his own solicitor.

In some cases, access to a solicitor may be delayed but only where the person has not yet been charged and is detained in respect of an indictable offence (i.e. an indictable-only or either-way offence). The delay can only be authorized by an officer or the rank of superintendent or above. The officer may only authorize delay if there are reasonable grounds for believing that:

a)It would lead to interference with or harm to evidence connected with an indictable office or interference with or physical injury to other people,
b)It would lead to the alerting of other people suspected of having committed such an offence but not yet arrested for it;
c)It would hinder the recovery of any property obtained as a result of such an offence; or
d)Where the person detained of the indictable offence has benefited from his criminal conduct, it will hinder the recovery of the value of the property constituting the benefit.

Even where the above conditions are satisfied, access to a solicitor may be delayed only for as long as the grounds exist and in any case no longer than 36 hours from the ‘relevant time’.

4. To have someone informed of his arrest.

A person who has been arrested and who is being held in custody at a police station or other premises has a right, at his request, to have one friend, relative or other person told of his arrest and the place where he is being detained. This is to be done as soon as is practicable. The custody sergeant must inform the suspect of this right and ask him whether he wishes to exercise it.

The person chosen by the detainee is to be informed of the detainee’s whereabouts at public expense and, if the detainee requests, on each occasion that he is taken to another police station. If the person they choose cannot be contacted, the detainee may choose up to two alternative people to be contacted. If they too cannot be contacted, the custody officer or the person in charge of the investigation has a discretion to allow further attempts until the information has been conveyed. If the detainee does not know of anyone to contact for advice, the custody officer should bear in mind local voluntary bodies who may be able to help.

Where a person is detained for an indictable offence (i.e.an indictable-only or either-way offence), an officer of the rank of inspector or above may authorize delay in giving notification of the detention for up to 36 hours from the ‘relevant time’. The conditions that must be satisfied before an officer can authorize delay in notification are the same as those required before delaying access to a solicitor.

5.To have an interpreter, in the case of someone who has difficulty understanding English or in the case of a deaf or mute person.

6.To communicate with his High Commission, embassy or consulate in the case of a foreign national.

If a detainee is a citizen of a country with which a bilateral consular convention or agreement is in force requiring notification of arrest, the appropriate High Commission, Embassy or Consulate shall be informed as soon as practicable, unless the detainee is a political refugee.

7.To have the person responsible for their welfare notified of his arrest and detention in the case of a juvenile.

8.To have an appropriate adult in the case of a juvenile, mentally disordered or otherwise mentally vulnerable person.

An appropriate adult in the case of a juvenile suspect is a parent or guardian. In the case of a person who is mentally disordered or vulnerable, an appropriate adult is a relative, guardian or other person responsible for the care or custody of him or someone who has experience of dealing with such persons (but who is not a police officer or police employee), or failing these, some other responsible adult aged 18 or over who is not a police officer or employee.

The role of an appropriate adult is:
a.to ensure that the detainee understands what is happening to him and why,
b.to support, advise and assist him,
c.to observe whether the police are acting properly and fairly and to intervene if they are not,
d.to assist with communication between the detained person and the police, and
e.to ensure that the detained person understands his rights and the appropriate adult’s role in protecting those rights.

9.To receive visits (at the custody officer’s discretion).

10.To have writing materials and to speak on the telephone for a reasonable time to one person.

The detainee must be told that what he says in any communication, other than to his solicitor, may be read or listened to and may be given in evidence.

※The ‘relevant time’ is the time the arrested person arrives at the police station or 24 hours after arrest, whichever is the earlier.
