체포된 피의자의 법적권리(하)

구금 기한

구금자 관련사항과 절차는 조속하게 진행되어야 하며, 구금할 필요가 사라지는 즉시, 석방되어야 한다.

보통 혐의 확정없이 구금할 수 있는 최대기간은 ‘적절한 시간’으로부터 24시간 동안이다. 그 시간 이후에도 혐의를 확정할 수 없다면, 보석을 전제로 혹은 보석없이 석방되어야 한다.

혐의 확정없이 구금할 수 있는 최대기간은 공소가능죄 (즉 가공소죄 혹은 선택가능죄)에 한해 연장할 수 있다. 이는 ‘적절한 시간’으로부터 최대36시간까지이며, 아래사항을 전제로 superintendant 이상 계급 경찰공무원의 승인이 필요하다.

 a.경찰관이 체포된 피의자의 혐의와 관련된 증거를 확보/보존하기 위해 구금이 필요하다고 판단하
    거나 혹은 그를 심문함으로서 혐의와 관련된 증거물을 획득할 수 있다고 믿는 경우;
 b.체포된 피의자의 혐의가 공소가능한 죄인 경우이어야 하고;
 c.수사는 성실하고 신속하게 진행되어야 한다.

경찰관이 구금기간 연장을 위한 영장을 신청하고, 치안판사법원에서 이를 승낙한 경우 구금기간은 최대 96시간까지 연장될 수 있다.

혐의사실이 확정된 경우

혐의사실이 있을 경우, 구금담당경찰관은 체포된 피의자를 보석으로 석방하던지 구금절차를 진행하여 구금하여야 한다. 체포된 피의자가 보석을 허가받을 경우, 구금담당경찰관은 법정출석일을 정해야 하는데, 이는 해당 치안판사법원에 처음으로 출석하는 날짜 이전에 정해져야 한다.

기소된 자가 경찰에 구금될 경우, 경찰은 그를 가능한 신속하게 치안판사법원으로 출석하게끔 해야 하는데, 이 역시 법원에 처음으로 출석하는 날 이전에 정해져야 한다. 그리하여, 피고인은 기소된 날 또는 그 다음날 법원에 출석하게 된다.

구금 조건

실행 가능함을 전제로 구금은 일인일실(一人一室)을 원칙으로 한다.

구금장소는 적절한 난방과 통풍, 청결이 유지되어야 하고, 적절한 조명이 있어야 한다. 담요, 매트리스, 베개 및 기타 침구는 적절한 품질로서 깨끗하고 위생적인 상태이어야 한다. 체포된 피의자가 화장실 혹은 세면시설을 사용할 수 있어야 하며, 수사의 목적으로 체포된 피의자의 옷을 압수하는 경우, 적절하게 깨끗하고 편안한 대체복이 제공되어야 한다.

24시간 동안 최소 두 번의 간식(light meal)과 한 번의 식사(main meal)가 제공되어야 한다. 식사시간 사이에도 합당한 요청이 있을 시, 음료가 제공되어야 한다. 실행 가능함을 전제로, 식사는 체포된 피의자의 종교적 믿음이나 필요에 합당하게 준비되어야 한다. 구금담당경찰관의 재량 하에, 체포된 피의자는 가족이나 친지가 사비로 준비한 식사를 제공받을 수 있다.

실행 가능한 경우, 체포된 피의자는 매일 간단한 야외운동을 허가 받을 수 있다.

체포된 피의자가 병이 있거나 부상을 입었거나 정신병을 앓고 있을 경우, 구금담당경찰관은 실행 가능한 즉시 이에 대한 적절한 조치를 받을 수 있도록 해주어야 한다.

구금기록부

경찰서에 구금되어 있는 동안, 체포된 피의자와 관련된 모든 사항은 문서로 기록되며, 그 기록은 custody record 라고 한다.

구금기록부라 하는 custody record의 기록은 체포된 피의자가 경찰서에 도착한 후 실행 가능한 즉시부터 시작되어야 한다. 구금담당경찰관은 PACE1984 또는 Codes of Practice(행동지침)에서 요구하는 모든 사항에 대해 빠짐없이 기록하여야 한다. 예를 들어, 체포된 죄목, 체포사유, 변호사 선임을 거부하거나 기타 다른 권리를 거부한 내역, 구금에 대한 평가 등의 내용을 포함한다.

변호사 혹은 적절한 성인은 체포된 피의자가 경찰서에 도착한 후 실행 가능한 즉시 체포된 피의자의 구금기록부를 열람할 수 있도록 허락되어야 하며, 구금기간 중 언제든지 혹은 구금이 끝난 이후라도 열람이 가능하여야 한다. 석방 후 최대 12개월까지 사이의 기간 중에 체포된 피의자는 자신의 구금기록부 사본을 받을 권리가 있다.

Detention time limits

All persons in custody must be dealt with expeditiously and released as soon as the need for detention no longer applies.

The normal maximum period of detention without charge is 24 hours from the ‘relevant time’. If at the expiry of that time the person has not been charged, he must be released, either on bail or without bail.

The period of detention without charge may be extended in respect of indictable offence (i.e. an indictable-only or either-way offence), up to a total of 36 hours from the ‘relevant time’ by an officer of the rank of superintendant or above, but only if:

a.The officer has reasonable grounds for believing that such detention is necessary to secure or preserve evidence relating to an offence for which the person is under arrest or to obtain such evidence by questioning him;
b.The offence for which he is under arrest is an indictable offence;
c.That the investigation is being conducted diligently and expeditiously.

It can be further extended for up to 96 hours from the relevant time by a magistrates’ court upon application by a constable for a warrant of further detention.

After Charge

Where a person is charged with an offence, the custody officer must either release him on bail or detain him in custody. If the person is granted bail, the custody officer must appoint a date for the first court appearance, which is no later than the first sitting of the relevant magistrates’ court.

Where a person charged with an offence is kept in police detention, the police must bring him before a magistrates’ court as soon as is practicable and in any event no later than the first sitting after he is charged with the offence. This will result in the accused person being brought before the court on the day he is charged or the next day.

Conditions of Detention

So far as practicable, not more than one detainee should be detained in each police cell.

Cells must be adequately heated, cleaned and ventilated. They must be adequately lit. Blankets, mattresses, pillows and other bedding supplied shall be of a reasonable standard and in a clean and sanitary condition. Access to toilet and washing facilities must be provided. If it is necessary to remove a detainee’s clothes for the purposes of investigation, replacement clothes of a reasonable comfort and cleanliness shall be provided.

At least two light meals and one main meal should be offered in any 24 hour period. Drinks should be provided at meal times and upon reasonable request between meals. As far as practicable, meals provided shall offer a varied diet and meet any specific dietary needs or religious beliefs the detainee may have. The detainee may, at the custody officer’s discretion, have meals supplied by their family or friends at their expense.

Brief outdoor exercise shall be offered daily if practicable.

If a detainee appears to be suffering from physical illness, or is injured or appears to be suffering from a mental disorder, the custody officer must make sure he receives appropriate clinical attention as soon as reasonably practicable.

Custody record

During a detainee’s time in custody at a police station, documentation is kept of all relevant matters relating to the detainee. The document is called a custody record.

A custody record must be opened as soon as practicable after a detainee’s arrival at the police station. The custody officer is responsible for recording in the custody record all matters that are required by PACE 1984 or the Codes of Practice e.g. the offence the detainee has been arrested for and the reasons for the arrest, any refusal to consult a solicitor or exercise any of his other rights, reviews of detention etc.

A solicitor or appropriate adult must be permitted to see the custody record of a detained person as soon as practicable after his arrival at a police station and at any time during the period of detention and after he has left the station. He is entitled to receive a copy of it up to 12 months after release.
