Penalties for Foreigners

1. 시민권자, 영주권자, 장기체류자, 일시체류관광객 등에 따른 법적용이 달라지는 것이있는지? 선거권, 경미범죄의 경우(약 1년 미만 구형이 예상되는 범죄) 수감하지 않고강제출국 시킨다든지?
Whether the application of the law is different according to whether you are a citizen, a permanent resident, a long-term resident on a visa or a visitor – Whether a foreigner is deported instead of being sent to prison if the offence is a minor issue (1 year or less in prison)

영국에서는 범죄인이 시민권자냐 외국인이냐에 상관없이 형사법 적용이 동일하게 이루어진다. 따라서 외국인이 감옥에 보내지는 것 대신으로 추방당할 수는 없다. 다만, 영국 시민권자가 아닌 사람이 유죄판결을 받을 경우 복역한 후에 추방당하는 경우는 있을 수 있다. 영국 시민권자는 추방당할 수 없다. (외국인이 추방당하거나 추방당하는 것이 권고되는 경우에 대한 사례는 이전 게시물 "영국 형사법 따라잡기⑫-이민법 관련사항" 참조 바람)
In the UK, the law regarding criminal trials and sentencing is applied in the same way to everyone, regardless of whether a person is a foreigner or a UK citizen. That means that a foreigner cannot be ordered by a court to be deported instead of being sent to prison. However, a person convicted of a criminal offence who is not a British citizen may be deported after serving their sentence. A UK citizen cannot be deported. (Please see the previous advice for the circumstances in which a non-UK citizen can be ordered or recommended to be deported).

외국인이 형사법위반으로 체포되어 수감된 경우, 그 외국인을 보석으로 풀어주느냐의 여부는 그 외국인의 이민상태에 따라 달라질 수 있다. 예를 들어, 수감자가 도주 위험이 있는지의 여부를 결정할때 법정은 다음과 같은 사항을 고려한다:
If a person is charged with a criminal offence, their immigration status might also have an impact on whether or not they are given bail by the court pending the final outcome of their case. For example, when considering whether or not a person is a flight risk, the court will take into consideration factors such as:

-A person’s immigration status (e.g. indefinite leave to remain, temporary visa, overstayer etc);

-How long they have been in the UK;
영국에 머문 기간
-Whether or not they have family members or other ties to the UK;
영국 내에 가족 구성원 또는 다른 연결관계가 있는지의 여부
-Whether or not they have a permanent address in the UK and how long they have been living there;
영국에 거주주소지가 있는지와 그 주소지에 얼마나 오래 머물었는지
-Whether or not they have a permanent job in the UK.

2. 영주권자, 장기체류자, 일시체류자 등이 중대 범죄 등을 범했을 경우, 판결전이라도영주권박탈이나 비자취소(있다면) 등 조치를 취하고 강제출국 시키는지? 아니면 처벌받은 후 강제출국 등 조치를 취하는지? 아니면 체류자격과 범죄는 관계없는지?
Whether the Border Agency has the right to revoke visas and resident permits of the person accused of committing a serious crime even before a verdict is given in court

국경청은 사안이 “공공의 이익을 위한 것”이라고 판단될 경우 비자를 취소할 수 있다. 내무부장관도 같은 판단 하에 영주권을 박탈하거나 강제추방을 명령할 수 있다. 이에 대한 재량권은 상당히 넓은 상황으로, 범죄자가 중대범죄를 저지른 것으로 판결되기 전인 피의자 신분으로도 조치가 취해진 경우가 있기는 하다. 하지만, 일반적인 경우, 법정에 판결을 받음으로써 이민상태가 변경되는 것으로 여겨야한다. 법정은 유죄판결을 내린 후에야 강제추방을 권고할 수 있다.
The UKBA can revoke visas if it is “conducive to the public good”. Similarly, the Secretary of State can revoke indefinite leave to remain or order deportation on the same ground. This appears to be a wide discretion and includes circumstances where a person has been accused but not yet convicted of a serious criminal offence. However, in most circumstances, it is likely that a review of a person’s immigration status will be triggered by a conviction rather than mere charges. A court can only recommend deportation upon conviction.

3. 가족 등이 병원이 아닌 집이나 사무실 등에서 사망했을 경우(자연사), 경찰이나 부검기관에서 범죄나 사고사가 아니라는 증명이 필요한지? 이를 위해서 어떤 조치를 취해야하는지?
If a family member has died (of natural causes) in his house or in his office and not in a hospital, will there need to be someone from the police or the coroner’s office to come and certify that the death was not caused by foul play or by accident? If so, what is the procedure for this?

사람이 집에서 사망한 경우, 그 가족의 G.P에게 우선 연락을 해야한다. 일방적인 경우G.P.는 그 집을 방문하여, 사망이 예상되었던 경우 사망 원인이 명시된 사망확인서를 써 줄것이다. 사망한 사람이 G.P.가 없거나 G.P.가 누군지 모를 경우 앰뷸런스를 대신 불러야한다.
When someone dies at home, their GP should be called as soon as possible. The GP will normally visit the house and, if the death was expected, should be able to issue a certificate giving the cause of death. If the person did not have a GP or you do not know the name of the GP, an ambulance should be called instead.

의사는 사인이 불분명할 경우 사망확인서를 써 줄 수 없게 되어있다. 이런 일이 발생할 시의사는 검시관에게 보고를 하고 시체는 병원 영안실로 이송되어 필요에 따라 부검이 실시된다.
A doctor is not allowed to issue a certificate if they are unsure about the cause of death. When this happens the doctor will report the death to a coroner and the body will be taken to a hospital mortuary, where a post mortem may need to take place.
