Section 87 of the Environmental Protection Act 1990 (EPA) is about littering and the Fixed Penalty Notice (FPN) that can be issued for littering offenses:
What it covers
Section 87 of the EPA makes it illegal to throw, drop, or leave litter in a public place or in a local authority's litter control area. This includes cigarette butts and chewing gum.
How it's enforced
An authorized officer can issue an FPN to someone they witness littering.
What the FPN is
The FPN amount is between £50 and £150, with £100 being the default. The FPN can be discounted to £60 if paid within 10 days.
What happens if the FPN isn't paid
If the FPN isn't paid within the specified time, the person will be liable for the original offense in the Magistrates' Court.
How to appeal
The person can appeal the FPN in writing. The appeal will be considered by an Appeals Panel within 10 working days.
A person is not guilty of a littering offense if the litter was deposited with the consent of the owner or occupier, or if it was authorized by law.
